Ruling from 2006 to be put into place, will change smoking a
San Francisco, CA -- (SBWIRE) -- 12/03/2012 -- Tobacco companies will now need to advertise they “deliberately deceived” Americans about the dangers of smoking. The companies must also admit that they manipulated their products to increase addictive qualities, said a U.S. judge on Tuesday.
All three giants of the industry, Philip Morris, Reynolds, and Lorillard, must state that smoking is responsible for the over 1,000 deaths every day that is caused by smoking.
U.S. District Judge Gladys Kessler’s ruling finalizes the wording for companies’ ads, which she ordered in 2006 after finding cigarette giants violated racketeering laws. She had ordered a “corrective statement on the topics at hand:
"The adverse health effects of smoking; the addictiveness of smoking and nicotine; the lack of any significant health benefit from smoking 'low tar,' 'light,' 'ultra light,' 'mild,' and 'natural,' cigarettes; Defendants' manipulation of cigarette design and composition to ensure optimum nicotine delivery; and the adverse health effects of exposure to secondhand smoke."
Each statement will begin with a "preamble" that briefly explains the court ruling, states the companies must make the statement and then declare, "Here is the truth."
A. The Adverse Health Effects of Smoking must be noted. A federal Court ruled that the company deliberately deceived the populous of America about the effects of smoking on one’s health. The companies must thus make a statement to that action.
B. The addictiveness of smoking and Nicotine must also be noted. The Federal Court has ruled that the tobacco companies must state deliberate deception of the American populous in regards to the addictiveness to smoking and nicotine.
C. The lack of benefits to one’s health in regards to smoking ‘Low Tar,’ ‘Light,’ ‘Ultra-Light,’ ‘Mild,’ and ‘Natural,’ cigarettes. The court has decided that the companies deceived the populous by falsely advertising that these alternatives to basic cigarettes had any positive health effects, or at least stayed the totality of negative effects.
D. The manipulation of cigarettes by design and composition alterations by the companies. Tobacco companies were found to have altered the composition of the products in order to up the level of its addictive qualities.
E. The adverse health effects of secondhand smoke and its overall causal capability. The court found that the tobacco company willingly ignored and downplayed the second-hand smoking effects that affect general health.
