The Los Angeles Unified School District argued that the 14-year old student gave consent in having a sexual relationship with her math teacher named Elkis Hermida.

The LAUSD argued that the student is mature enough to consent to having sex with her 28-year old teacher and said that the girl has a responsibility for what had happened. As part of their defense strategy, the school district also presented the girls sexual history, which the girl’s camp appealed to. The Los Angeles Unified School District claims that they are not aware of the relationship between the student and the teacher. They were even cleared last year of wrong doing by a civil jury in Los Angeles superior court. The girl was not awarded any damages for what she said she suffered during her five-month relationship with her teacher.
