Varn Chandola, DUI Attorney Seattle who is an accomplished DUI lawyer explains in his most recent blog post, “DUI Law for Bicyclists in Washington“, that one will not be convicted of DUI in Washington for riding a bicycle under the influence of alcohol or marijuana.

“DUI laws in Washington only apply to those to drive a motor vehicle” Chandola DUI Lawyer Seattle says.

He however warns travellers that DUI laws differ from state to state, so it is important not to assume that other states follow Washington’s model. He compares for instance that “in Oregon, our next door neighbour, riding your bicycle under the influence of alcohol is a DUI offence”. He adds that Washington has further amended its DUI laws after legalizing marijuana.

“Although driving under the influence of controlled substances was prohibited under Washington DUI law even prior to the legalization of marijuana, the state now has added a provision which specifically prohibits driving under the influence of marijuana” Chandola states.

However, similar to riding a bicycle under the influence of alcohol, Chandola says that “In Washington, riding a bicycle under the influence of marijuana is also not a DUI offence.” Once again pointing to Oregon law, he states that “In Oregon riding your bicycle under the influence of either alcohol or marijuana is prohibited under the state’s DUI law”.

The reason why Kent DUI Attorney, Chandola likes to compare Washington and Oregon DUI laws is to demonstrate how the legal status of travellers can change so drastically by merely crossing a state line.
