Preparing for a Worker's Compensation Independent Medical Exam – Tip Sheet

Provides 5 tips on how injured workers can prepare for an independent medical exam to determine the appropriate amount of worker’s compensation benefits.

 

Plainview, NY -- (SBWIRE) -- 12/21/2017 -- If a worker has been seriously injured at work, that worker may need an independent medical exam (IME) to determine worker's compensation benefits. If an IME has been scheduled, here are five ways to prepare, according to Robert Golan, PC of Golan & Masiakos, LLP:

1. Talk to an attorney

A worker's compensation disability attorney is the most valuable asset when navigating a worker's compensation claim. A good lawyer can help use the independent medical exam to benefit the injured worker. For example, the attorney may advise the injured worker to focus on a particular aspect of the injury and how it impacts his/her quality of life or provide specific information about the examiner assigned to the worker's case.

2. Bring a witness

The attorney may ask the injured worker to bring a witness to the IME. A witness can be useful if there are concerns about the fairness of the exam. When bringing a witness to an IME, select a trusted friend or family member to come along to the appointment. Ask the witness to take notes on the details of the exam, such as what questions the doctor asked, what tests he/she performed, and other relevant details. The witness should not actively participate in the IME by answering questions or adding details to the statements. Choose a witness who will quietly observe the examination.

3. Write notes

When entering the examiner's office, the injured worker might have a long list of symptoms in mind, but explaining these symptoms on command and in detail is another matter. Organize the thoughts beforehand by writing out a list of symptoms from the injury, the activities that no longer can be performed because of the injury, a list of activities that make the injury worse, and any treatments or medications that have been provided by other medical professionals.

4. Arrive early

Most medical examiners request that paperwork be completed before the appointment. Arrive 15 to 30 minutes early to keep the examination on schedule and make a good first impression.

5. Be honest

Although it is important that the examiner understands the full effects of the injury, don't exaggerate the symptoms during the IME. Be completely honest about the extent of the injury. If the treatment is improving the symptoms, inform the examiner.

Following these five tips can make an independent medical exam be less stressful and make sure that the injured worker gets the proper compensation for the work injury and assure that the injured worker can regain his/her health.
