Wasilla, AK -- (SBWire) -- 02/01/2019 --Bayer, one of the largest pharmaceutical companies in the world posted a notice on its website on July 20, 2018 stating that it will voluntary stop selling Essure in the United States for business reasons. The notice advised that the birth control devices would no longer be available after December 31, 2018. Such a decision was made after months of the Food and Drug Administration (FDA) ordering that the Essure birth control device be further restricted due to concerns about the serious health risks to women. One article stated that, "the FDA took the step because of information indicating that women were not being adequately warned about the potential side effects and complications they could face. However, the company maintains its opinion that Essure is safe and effective."

Essure is a small spring like device that is made from a nickel titanium alloy. The device is inserted into the fallopian tubes through the cervix. Over a course of several months scar tissue builds up around the coils creating a physical barrier preventing sperm from reaching a woman's eggs. After the initial insertion patients are supposed to go back to their doctors after three months for confirmation to ensure that the device is working properly to prevent pregnancy.

The device was marketed as being safe and convenient, however, a number of problems have been identified with regards to the birth control device. 'Some of these problems include severe pain, allergic reactions and permanent sterility. Thousands of women have reported suffering painful and serious complications including ovarian cyst ruptures, fatigue, significant weight loss, bleeding and chronic pain. Some women have had the device removed, surgically, because of how the device can migrate and rupture vital organs.

"There are many complications that are associated with birth control devices including blood clots, infertility or even more mild side effects, however, the mild side effects may not qualify for monetary compensation. When a birth control device fails to do what it is supposed to do or presents side effects that result in complications or serious problems the affected individual can file a product liability lawsuit for damages they have suffered as a result of the birth control device", A Crowson Law Group attorney commented. In addition, the attorney stated that, "It is important to realize what you can and cannot sue for when it comes to birth control lawsuits resulting in complications. For example, you cannot sue for becoming pregnant as the makers of birth control do not promise their products will completely eliminate the chances of pregnancy. However, you can sue for ectopic pregnancies, infertility, blood clots, birth defects in children were conceived while using the birth control or in worst cases death resulting from the birth control. Once it has been established that you can sue for the complications and serious problems associated with the birth control you have been using, it is necessary to establish negligence on the part of the manufacturer or administering physician."

In order to establish negligence, it is necessary to prove that the manufacturer owed the consumer a duty, this duty was breached and as a result the consumer was injured. If you have suffered injury as a result of the use of a birth control device because of the way the device was inserted or a defect in the device itself, seek out an accident attorney in Alaska and the best attorney for personal injury to handle products liability matters.
