Initially, the firm screen cases based upon the year, make and model of the vehicle, the types of problems the buyer has experienced and in the case of lemon law, the number of repair attempts that have been performed under warranty. This typically involves gathering and reviewing the repair orders for the vehicle, the sale documents and listening to the buyer’s experience with the vehicle from purchase to date. It is not unusual for clients to feel very strongly about the vehicle’s defects and the treatment they have received at selling and repairing dealerships. The place that vehicles take in monthly budgets contributes to a buyer’s desire to seek help and restitution for poorly operating and designed vehicles.

Once a case appears to fit the consumer protection statute’s requirements, research is performed regarding particular problems. The internet is a vast reservoir of information regarding vehicles and it is not unusual for internet research to reveal other owners saying the same thing about a particular vehicle and its problems or a particular dealership and its sales practices. A manufacturer’s technical literature is also a good source of information particularly regarding the history of a vehicle’s defects and the manufacturer’s attempts to respond to widespread problems. A single sentence in the technical literature can sometimes be a “game-breaker.”

Many cases settle early in the process once the client’s claims are presented to the manufacturer and/or selling dealer. These cases can be concluded in two to three months with little expenditure of time by the clients. Other cases, however, go into the discovery process which can involve a vehicle inspection, depositions and retention of experts.

The good part is that the client does not have to pay for these services. The consumer protection statutes all provide for the consumer’s attorney’s fees and costs to paid for by the defendants should the case prevail. Mr. Law takes all his cases on a contingency basis at no charge to the client. In the unlikely event the case is not successful, the law firm does not get paid.
