Software Developer Code Rebel Wins Judgment Against Aqua Connect in Federal Lawsuit

Federal Judge Enters Judgment Denying All Claims In Rival Software Developer’s Lawsuit

Los Angeles, CA -- (SBWire) -- 08/28/2014 --Remote desktop software developer Code Rebel, LLC today announced that it has received a judgment in its favor on all claims in a lawsuit brought by Aqua Connect, Inc., a rival software developer. The judgment stated that Aqua Connect failed to establish any act of reverse engineering by Code Rebel or any other illegal act that would support any of Aqua Connect’s claims.

Founded in 2006, Code Rebel is an innovative software development company with two Mac remote desktop access software applications: iRAPP and iRAPP Terminal Server. The iRAPP application – “Interactive Remote Application” – is a remote access software suite that allows users to work seamlessly and simultaneously on both PC and Mac.

In 2011, Aqua Connect filed a lawsuit against Code Rebel, its Chief Executive Officer, Arben Kryeziu, and Chief Technology Officer, Volodymyr Bykov, claiming that Code Rebel had, among other things, misappropriated Aqua Connect’s trade secrets and breached a click-through end user license agreement by reverse engineering a software program allegedly developed by Aqua Connect, in order to create Code Rebel’s iRAPP and iRAPP TS software programs.

In February of 2012, a United States District Court Judge in Los Angeles dismissed Aqua Connect’s trade secret claim. The dispute was subsequently referred to arbitration and decided by a jointly appointed arbitrator with significant experience in computer science. Code Rebel prevailed.

On August 19, 2014, the same United States District Court Judge confirmed the findings of the arbitrator and entered judgment in favor of Code Rebel, Mr. Kryeziu and Mr. Bykov on all of the claims alleged by Aqua Connect, including breach of contract, unjustly enrichment, and unfair business practices under California law.

More important, the Judgment entered by the Federal Court expressly and unequivocally stated that:

“Aqua Connect has failed to establish any act of reverse engineering by Code Rebel or any other illegal act that would support any of its claims.”

In response to the Judgment in favor of Code Rebel, Mr. Kryeziu, said “We are delighted with the judgment of the Federal Court which validates our position from the very beginning of this dispute: that we have developed our groundbreaking iRAPP program for remote server access through the hard work and ingenuity of our employees, rather than through inappropriate means.” Mr. Kryeziu further said “We are excited about expanding and improving our innovative, effective product that fills a need that is so important to so many of our customers.”

Code Rebel has also filed a separate lawsuit against Aqua Connect alleging false and misleading comments made by Aqua Connect’s personnel, as part of a pattern of trade libel designed to denigrate the quality and development of Code Rebel’s products. Code Rebel’s lawsuit against Aqua Connect is scheduled to go to trial in 2015 and expects to prevail in that dispute as well.
