Los Angeles, CA -- (SBWIRE) -- 08/15/2016 -- Consumer Action Law Group settles auto fraud case. Hector Carillo v. C&A Motors, Aracelioza Herrera, Financial Partners Credit Union, and American Contractors Indemnity Company. Superior Court of Kern County. Case: S-1500-CV-284125.
Consumer Action Law Group of Panzarella, Gurevich, and Rodes, PC and their auto fraud attorneys have successfully settled a claim involving their client Hector Carillo and car dealership Aracelioza Herrera dba C&A Motors, Financial Partners Credit Union, and American Contractors Indemnity Company.
Mr. Carillo hired auto dealer fraud lawyers Consumer Action Law Group to file an auto fraud lawsuit in superior court of Kern County, seeking full recovery of the money he paid, including general damages of the vehicle, incidental and consequential damages, punitive damage, statutory damages, and equitable and injunctive relief. Mr. Carillo recently entered into an agreement to resolve his claims against the dealer.
According to the complaint filed by his attorneys, Mr. Carillo was sold a car and the dealer promised that it was in great condition, and free from any mechanical or structural defects. Soon after buying the car, Mr. Carillo immediately started experiencing electrical issues and the dealer failed to communicate with Carillo or to repair the vehicle. On Mr.Carillo's way to meet his wife, who was in the hospital in labor, smoke and flames started coming out of the front of the car and it burst into flames as he was pulling out of his driveway with his child in the back seat. The fire ignited Mr. Carillo's work truck, the roof of his home, and part of his house as well as scorching his car.
In California, auto dealers are legally required to disclose the true and known condition of a vehicle at the time of the sale. A dealer must inform a buyer of any defects or any prior accidents or damage. California consumer laws also require car dealers to sell cars for the price that is advertised, and to follow strict rules about documenting down payments. When a dealer does violates the consumer laws in California, attorneys fees are awarded by the court under the Consumer Legal Remedies Act.
According to Mr. Carillo's auto fraud attorney, Pauliana Lara, "We filed a lawsuit and we were actively engaged in several months of litigation, which prompted the dealer and related parties to come to the table to negotiate a resolution. The dealer agreed to compensate Mr. Carillo for the claims brought forth and to settle the case out of court." Pauliana Lara and her dedicated auto fraud team entered into a complete settlement of all claims related to Mr. Carillo's vehicle with dealer, finance, and the insurance company. Pauliana Lara and her colleagues have filed many cases similar to Mr. Carillo's, fighting for the rights of consumers in California.
Mr, Carillo said that he was very pleased with the result and was glad to return the vehicle to the dealer and have his case resolved. Consumer Action Law Group and their team of auto lawyers helps car buyers such as Mr. Carillo to sue the car dealer for auto dealer fraud and to represent consumers who have been ripped off by car dealers.
