The State of California recently established the Home Care Services Consumer Protection Act which came into effect in January 2016. This new law requires all Home Care Organizations (HCOs) in the State to have a license to operate and is designed to uphold consumer protection for older adults who hire private caregivers to provide service with activities of daily living (ADLs) in the home.

Under this new act, affiliated caregivers of HCOs are also required to register as Home Care Aides with the California Department of Social Services. The registration process requires them to submit an application, sign a criminal record statement, perform Live Scan fingerprinting and be cleared of TB. This law was enacted to promote the protection of seniors and reduce the risk of elderly abuse.

Abuse for the elderly can come in multiple forms and not just violence. One major abuse with Seniors today is fraud. Fraud is rampant in medical identity theft through healthcare insurances such as Medicare, where perpetrators use stolen Medicare ID cards to bill for services that elderly patients never received. Other situations include imposters representing professional companies that cater to Seniors and coercing the most vulnerable of elders, those who suffer from early onset dementia or others in a weak and frail state, into revealing and accessing their bank accounts.
